Guwahati turned tense on September 25 as the Special Investigation Team (SIT), along with the Criminal Investigation Department (CID), raided the residence of Shyamkanu Mahanta, chief organiser of the North East India Festival in Singapore and the man who had taken Zubeen Garg abroad for the event where the singer met his tragic end.

Officials confirmed that a case has now been registered against Mahanta under Sections 61(2), 105, and 106(1) of the Bharatiya Nyaya Sanhita (BNS), 2023, in connection with the death of the legendary Assamese singer. The development has intensified protests across Assam, with citizens demanding swift justice and accountability.

What Do These Sections Mean?
Section 61(2) – Criminal Conspiracy in Serious Offences

This section deals with criminal conspiracy to commit offences punishable with death, life imprisonment, or imprisonment of two years or more. The punishment is the same as if the person had actually abetted the crime itself.

Section 105 – Abetment Leading to Death

Section 105 applies when a person’s instigation, abetment, or conspiracy leads to the death of another, though the act may not fully qualify as murder.
The punishment includes imprisonment for life, or a term of not less than five years, extendable up to ten years, along with a fine.

Section 106(1) – Death by Negligence

This section covers cases of causing death by rash or negligent acts. It includes situations where medical or factual negligence directly results in a death. For registered medical practitioners, a distinct provision prescribes up to two years of imprisonment and a fine.

Protests Intensify Across Assam

The charges against Mahanta come amid growing anger among Zubeen Garg’s fans and civil society. Protests have erupted across the state, with many demanding his immediate arrest and a CBI inquiry to ensure impartiality.

Adding to the tension, several organisations have called for statewide demonstrations and cultural tributes to honour Zubeen’s legacy, while also pressing the government for stronger action against those held responsible.

The SIT is expected to continue interrogating Shyamkanu Mahanta in the coming days. With the charges now framed under serious sections of the BNS, legal experts suggest that the case could mark a turning point in Assam’s ongoing pursuit of justice in the Zubeen Garg death case.
As the probe deepens, the big question remains: Was negligence, abetment, or conspiracy at play in the tragic loss of one of Assam’s greatest cultural icons?
